Keep Pace with Oregon Wine Laws
Oregon is one of the fastest-growing wine producing states in the U.S. With the increase in the number of commercial wine ventures, the number of laws and regulations pertaining to wine production and distribution has increased as well. At HRG, our Vineyard and Winery Law Team stays apprised of all state and federal legislation that may affect Oregon vineyards and wineries, as well as requirements from the Oregon Liquor Commission, Oregon Land Conservation and Development Commission, and other regulatory bodies. That way, you can focus on your vineyard or winery. Whether you’re a wine producer, distributor, or retailer, an HRG Vineyard and Winery Law attorney can help bring you up to speed on crucial regulatory requirements, including:
- Federal Producer Permit
- Federal Wholesaler Permits
- Conditional-Use Permits
- Unconditional-Use Permits
- Licensing Applications
- Licensing Renewal Applications
- Off-Premises Sales Licenses
- Distribution Agreements
- Contract Reviews
- Zoning Laws
- Land-Use Laws
- Citizen and Non-U.S.-Citizen Labor Laws
Considering a Food-Service Plan?
State land-use rules wisely prioritize the preservation of Oregon farmland for agriculture uses. Though recent state legislation provides newfound flexibility for food services like winemaker dinners and food pairings, it’s important to remember that Oregon law still limits food service on Oregon farmland. A lawyer from the HRG Winery and Vineyard Law Team can help you determine whether a food-service plan for your vineyard or winery is authorized, as well as whether or not your operation is in compliance with important statutes like: SB 841, ORS 215.283, ORS 215.452, and others. Did You Know?
Oregon’s labeling requirements for wine are some of the strictest in the United States. Though the federal government requires that the varietal on the label—whether it’s Pinot noir, Pinot gris, Pinot blanc, Chardonnay, or another varietal—makeup only 75% of the winegrapes used in production, the state of Oregon requires a minimum of 90% of the stated varietal. Be sure that your wine is in compliance with state and federal regulatory requirements with help from an HRG Vineyard and Winery Law attorney.
